General Terms and Conditions

Below are our standard events terms and conditions.



1. Westpac New Zealand Limited (Westpac) are hosting *House of Credit Card Fears* ("Event"). By registering to attend the Event, you (“the Participant”) acknowledge and agree that these terms and conditions (“Terms”) apply to your attendance of this Event.



2. When you are on-site at an Event venue, you are required to adhere to all instructions from venue and event staff. Westpac reserve the right to remove any participants who do not adhere to instructions from venue and event staff members. It is a condition of entry that a search of a person and / or their possessions may be required at the time of the entry to and / or exit of the venue.



3. You consent to Westpac carrying out filming, sound recording and/or photography at the Event as a participant and you consent to the use by Westpac of any such recording or photography for promotional, marketing and other purposes.



4. You consent to Westpac entering your personal details into the Event database which will be used for the administration of the Event. Westpac collects personal information to manage participation in the Event.



5. Westpac will not be liable to you for any loss or damage (including consequential loss or damage, loss of profits, loss of revenue or loss of savings) which may be suffered or incurred, or which may arise directly or indirectly in respect of your participation in the Event.



6. All conditions and warranties which may be implied by law into these Terms are excluded except to the extent that it would be unlawful to do so. You agree that to the extent that you are acquiring goods or services under these Terms for the purposes of a business, the guarantees provided under the Consumer Guarantees Act 1993 shall not apply to Westpac’s supply of such goods and services.



7. To the extent permitted by law, you will indemnify Westpac against any costs, losses and damages and will, at your cost, defend or settle any claim suit, action or proceeding brought against Westpac arising from: (a) any breach of these Terms by you; and (b) your participation in the Event.



8. You understand that your information will be collected and shared by Flicket, to Westpac. Information about Flicket’s privacy policy can be found here: Flicket Privacy Policy. Westpac collects and processes your personal information for the purposes of facilitating the Event. Collection: We collect the personal information you provide to us either directly from you, or indirectly from Flicket. Use and Disclosure: We use your personal information for a range of purposes including attendee lists, contact tracing and to contact you after the Event. Assumption of Risk and Release of Liability

By attending the *House of Credit Card Fears* ("Event"), you acknowledge and agree to the following:

1. Inherent Risks: You understand that the Event involves intense audio and visual effects, including but not limited to strobe lighting, loud noises, fog, sudden actions, physical environments with uneven surfaces or obstacles, and close interaction with live performers. These elements are designed to startle, frighten, and disorient participants and may not be suitable for all individuals.



2. Voluntary Participation: Attendance at the Event is entirely voluntary. By entering the premises, you assume all risks associated with participation, including but not limited to personal injury, emotional distress, or medical conditions that may be triggered or aggravated by the Event.



3. Health Conditions: You confirm that you do not suffer from any medical condition, including but not limited to heart conditions, epilepsy, respiratory issues, or mental health disorders (such as severe anxiety or PTSD), which could be affected by participation in the Event. If you have any concerns about your health or ability to participate safely, you are advised not to attend.



4. Limitation of Liability: To the fullest extent permitted by law, Westpac, its employees, agents, contractors, and affiliates (collectively, the “Organiser”) shall not be liable for any injury, illness, loss, damage, or death sustained by any attendee arising out of or in connection with participation in the Event, howsoever caused, including but not limited to negligence.



5. Indemnification: You agree to indemnify and hold harmless the Organiser against any claims, liabilities, damages, costs, or expenses (including legal fees) arising from your attendance at the Event.



By registering for and/or attending the Event, you acknowledge that you have read, understood, and agreed to this liability waiver and assumption of risk.
